Terms of Service

1. Acceptance of Terms

By accessing or using MyndL ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

MyndL is a subscription-based web application for creating mind maps to visualize thoughts, feelings, and behaviors. The Service includes local storage, Google Drive synchronization, and pattern analysis features.

3. Account Registration

You must sign in with a Google account to use the Service. You are responsible for maintaining the security of your Google account. You must be at least 13 years old to use the Service.

4. Subscription and Billing

Free Trial: New users receive a 14-day free trial. No payment is required during the trial period.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless canceled.
Cancellation: You may cancel your subscription at any time from the Settings page. Upon cancellation, you retain access until the end of your current billing period.
No Refunds: We do not issue refunds for partial billing periods or unused time. When you cancel, your access continues until your current period expires.
Price Changes: We may change subscription prices with 30 days' notice. Existing subscribers will be notified before any price change takes effect.
Plan Changes: You may switch between monthly and annual plans at any time. Changes are prorated.

5. Your Data

Your mind map data is stored locally on your device and in your personal Google Drive.
We do not store, access, view, or process your mind map content on our servers.
You own all content you create using the Service.
You are responsible for backing up your data. Clearing your browser data or revoking Google Drive access may result in data loss.

6. Account Deletion

You may delete your account at any time from the Settings page. You must cancel your subscription before deleting your account to prevent continued billing. Upon deletion:

Your profile and subscription data are permanently removed from our systems.
Your local browser data is cleared.
Files in your Google Drive are NOT automatically deleted. You may remove them manually.
This action cannot be undone.

7. Acceptable Use

You agree not to:

Use the Service for any illegal purpose.
Attempt to gain unauthorized access to the Service or its systems.
Reverse engineer, decompile, or disassemble the Service.
Share your account credentials or allow others to access your account.
Use the Service to store or transmit malicious code.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MyndL is NOT a medical device, therapeutic tool, or substitute for professional mental health care. We make no claims about therapeutic or medical benefit. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYNDL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Modifications to Terms

We may update these Terms from time to time. We will notify users of material changes via the app or email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration.
